When providing our services, selling goods and operating our website, we process certain personal data.

 

The processing of personal data is governed primarily by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

 

2. What personal data we process, why, and for how long

 

A) Contact (contact form / email / messages)

 

If you contact us, we process mainly the following data:

 

  • name and surname (if provided),

  • email address,

  • phone number (if provided),

  • the content of your message and any attachments,

  • technical data necessary to deliver and handle your message.

 

 

Purpose: handling your request/inquiry and communicating with you.

Legal basis: Article 6(1)(b) GDPR (pre-contractual measures / performance of a contract) or Article 6(1)(f) GDPR (our legitimate interest in handling communication).

Retention period: generally up to 12 months from our last communication, unless your inquiry results in an order or another legal obligation.

 

B) Orders and purchases (contract, invoicing, delivery, complaints/returns)

 

When you purchase from us, we process the personal data necessary to conclude and perform the purchase contract, in particular:

 

  • name and surname,

  • delivery address,

  • email address and phone number,

  • ordered goods, price, shipping and order details,

  • billing details (if different),

  • Company ID / VAT details (if purchasing as a business),

  • payment and order status information,

  • data necessary for handling complaints, returns or withdrawal from the contract.

 

Purpose: order processing, delivery of goods, communication about your order, handling complaints/returns/withdrawals, accounting and compliance with legal obligations.

Legal basis:

 

  • Article 6(1)(b) GDPR (performance of a contract),

  • Article 6(1)(c) GDPR (compliance with legal obligations – accounting, tax obligations, complaint handling).

    Retention period: for the duration of the contractual relationship and subsequently for the period required by applicable law (especially accounting and tax regulations). Data required for complaint handling is retained for the duration of statutory liability for defects and to document the handling of complaints.

  

C) Payments (Shoptet Pay, bank transfer)

 

For payments we process data necessary to perform and record the payment (e.g., order identification, amount, currency, payment status).

 

  • Online card payment via Shoptet Pay: payment data are also processed by the payment service provider (Shoptet Pay) in accordance with its own terms. The Shoptet Pay terms are available at:

  • Bank transfer: we process data necessary to match the payment (e.g., reference/variable symbol, note, amount, date).

 

 

Purpose: performing and recording payments.

Legal basis: Article 6(1)(b) GDPR (performance of a contract) and Article 6(1)(c) GDPR (accounting and tax compliance).

 

D) Newsletter / marketing communication

 

If we send you marketing emails (newsletter), this may occur in the following situations:

 

  1. Newsletter based on consent (e.g., you subscribe to our newsletter)

    Legal basis: Article 6(1)(a) GDPR (consent).

    Withdrawal of consent: at any time (unsubscribe link in the email or by contacting us at info@ljubavnahrvatska.com).

    Retention period: until consent is withdrawn.

  2. Newsletter to existing customers (where permitted and with a simple opt-out option)

    Legal basis: Article 6(1)(f) GDPR (legitimate interest – informing existing customers about similar products), always with an unsubscribe option.

    Retention period: reasonably necessary, typically until you unsubscribe or max. 2 years from your last purchase.

 

 

You can opt out of marketing emails at any time.

 

 

3. Who may access your data (Recipients / Processors)

 

Your personal data remain primarily with us, however, certain third parties may have access to your data because they help us operate the e-shop and provide our services, in particular:

 

  • E-shop platform provider Shoptet (Shoptet, a.s., Dvořeckého 628/8, 169 00 Prague 6, Czech Republic, Company ID: 28935675)

  • Shoptet Pay payment service provider (for card payments) – depending on the selected payment method

  • Carriers / courier companies (according to your selected delivery method, to the extent necessary for delivery – name, address, contact details, shipment information)

  • Email and technical infrastructure providers (e.g., sending transactional emails)

  • Analytics and marketing providers (e.g., website traffic measurement, advertising systems) – only to the extent and under the conditions defined by cookies settings and your consent

 

We process personal data mainly within the EU/EEA. If we use tools that may involve transfers outside the EU/EEA, we do so only where legal requirements are met (e.g., Standard Contractual Clauses or other appropriate safeguards).

 

4. Automated decision-making and profiling

 

We do not carry out decisions based solely on automated processing, nor profiling that produces legal effects concerning you or similarly significantly affects you.

Under GDPR you have, in particular, the right to:

  • access your personal data,

  • rectification,

  • erasure (“right to be forgotten”) in cases provided by GDPR,

  • restriction of processing,

  • data portability,

  • object to processing (especially where based on legitimate interest),
